Article 1 – Identity of the Operator

The accommodation is operated under the name Au Double Moulin, located in La Chapelle Montbrandeix, France (hereinafter referred to as “the Operator”).

These General Terms and Conditions have been drawn up in accordance with French law, in particular the provisions of the French Civil Code (Code civil), the French Tourism Code (Code du tourisme) and the French Consumer Code (Code de la consommation) where applicable.

Article 2 – Scope of Application

2.1 These terms and conditions apply to all bookings, agreements and stays relating to the gîtes (furnished holiday accommodation) operated by Au Double Moulin.

2.2 By making a booking, the customer (hereinafter referred to as “the Tenant”) confirms that they have read, understood and unconditionally accepted these terms and conditions.

2.3 Any deviations from these terms and conditions shall only be valid if confirmed in writing by the Operator.

2.4 Should any provision be declared invalid, the remaining provisions shall remain fully applicable.

Article 3 – Booking and Formation of the Agreement

3.1 Bookings can be made by email or via the contact form on the website.

3.2 A booking becomes final once:

  • written confirmation has been issued by the Operator; and

  • the deposit of 30% of the total amount has been received.

3.3 The agreement concerns temporary rental without establishing a main residence, in accordance with Articles 1713 et seq. of the French Civil Code.

3.4 The maximum permitted number of guests per accommodation may not be exceeded without prior written approval. Exceeding this number may result in immediate termination of the agreement without reimbursement.

3.5 The Operator reserves the right to refuse any booking without providing reasons.

Article 4 – Prices and Payment

4.1 All prices are stated in euros.

4.2 A deposit of 30% must be paid within 10 days of receipt of the invoice.

4.3 The remaining balance must be paid no later than 14 days before arrival.

4.4 For bookings made less than 14 days before arrival, the full amount must be paid immediately.

4.5 In the event of non-payment by the due date:

  • the booking shall automatically be cancelled;

  • the deposit shall be retained by the Operator;

  • the accommodation may be made available for rebooking.

4.6 The accommodation may not be occupied until full payment has been received.

Article 5 – Security Deposit

5.1 A security deposit of €300 or €500, depending on the accommodation, is required upon arrival.

5.2 The security deposit covers:

  • damage to the building or furnishings;

  • loss of keys;

  • excessive cleaning costs;

  • excessive energy or water consumption;

  • unpaid additional charges.

5.3 If no damage is found, the security deposit will be refunded within 14 days after departure.

5.4 If the cost of damage exceeds the amount of the security deposit, the Tenant remains liable for the outstanding balance.

Article 6 – Cancellation Policy

6.1 Cancellations must be made in writing by email.

6.2 Cancellations made up to 30 days before arrival may be cancelled free of charge.

6.3 For cancellations made up to 14 days before arrival, the deposit (30%) remains payable.

6.4 For cancellations made less than 14 days before arrival, 100% of the total stay remains payable.

6.5 No refund will be granted in the event of early departure.

6.6 Force majeure affecting the Tenant (illness, transport issues, pandemics, weather conditions, etc.) does not release the Tenant from payment obligations. Taking out cancellation insurance is strongly recommended.

Article 7 – Cleaning and Condition of the Accommodation

7.1 Final cleaning is included in the rental price.

7.2 The Tenant must leave the gîte:

  • tidy, swept clean and free of rubbish;

  • with the kitchen (including the oven) cleaned;

  • with the barbecue and fireplace cleaned.

7.3 If additional cleaning is required, a charge of €25 per hour will be applied.

7.4 In cases of excessive dirt or damage, additional compensation may be claimed.

Article 8 – Safety, Ponds and Supervision of Minors

8.1 The estate includes natural features such as ponds, a river, water areas, changes in level, steps and uneven terrain.

8.2 Staying on the estate is entirely at the Tenant’s own risk and that of their party.

8.3 Minors must at all times, without exception, be directly and actively supervised by a parent or legal guardian, regardless of their location on the estate (indoor areas, garden, terrace, near ponds, car park, etc.).

8.4 It is strictly forbidden to allow minors to move around the estate without supervision.

8.5 The Operator cannot be held liable in any way for:

  • drowning, falls or accidents in or around the ponds;

  • accidents resulting from a lack of parental supervision;

  • incidents caused by failure to follow safety instructions.

8.6 Full responsibility for minors rests exclusively with their parents or legal guardians, in accordance with Article 1242 of the French Civil Code.

Article 9 – Pets and Smoking

9.1 Pets are only permitted in the gîte with prior written approval and subject to an additional charge.

9.2 Smoking is strictly prohibited indoors. Smoking is only permitted outdoors.

9.3 Any violation may result in a fixed charge for deodorising and cleaning, without prejudice to any additional compensation for further damage.

Article 10 – Liability

10.1 In accordance with Articles 1240 et seq. of the French Civil Code, the Tenant is liable for any damage caused by themselves, co-tenants or third parties who access the estate with their permission.

10.2 The Operator shall not be liable for:

  • accidents occurring inside or outside the estate;

  • theft or loss of personal belongings;

  • temporary interruptions to water, electricity or internet services;

  • damage caused by force majeure or external events.

10.3 Use of the swimming pool, garden, steps and natural surroundings is entirely at the Tenant’s own risk.

10.4 The Operator’s liability shall in all cases be limited to the amount of the stay, except in cases of intentional misconduct or gross negligence.

Article 11 – Complaints

11.1 Complaints must be reported immediately during the stay to the Operator (who resides on the estate) or by email.

11.2 If no complaint is made during the stay, any right to compensation shall lapse.

Article 12 – Force Majeure

12.1 In the event of force majeure within the meaning of Article 1218 of the French Civil Code (fire, natural disaster, pandemic, government measures, technical impossibility, etc.), the Operator may cancel or modify the booking without compensation.

12.2 In such cases, the maximum amount refunded shall be the amount already paid, without any additional compensation.

Article 13 – Website and Information

13.1 All information provided on the website is supplied in good faith and may be amended.

13.2 Obvious errors or material inaccuracies shall not be binding on the Operator.

13.3 Photographs are for illustrative purposes only and are not contractual.

Article 14 – Applicable Law and Jurisdiction

14.1 This agreement is governed exclusively by French law.

14.2 Any disputes shall fall exclusively under the jurisdiction of the court of the district in which the estate is located.
